Mike Bennett Still Hearts Voter Suppression

Mike Bennett, Supervisor of Elections, for Manatee County, and Republican commissioners has eliminated voting locations. It will comes as no surprise the the majority of voting stations were eliminated in a Democratic leaning district.

Democratic County Commissioner Michael Gallen's District 2, which includes most of Palmetto and central/east Bradenton, has the largest percentage of closed polling places.

"I do have concerns about the closings of the precincts, especially in District 2, where 50 percent will be closed," said Gallen.

During his time in the Florida Senate, Bennett publicly advocated for making voting more difficult. Bennett also brought up a racial component by mentioning "Africans."

“Do you read the stories about the people in Africa? The people in the desert, who literally walk two and three hundred miles so they can have the opportunity to do what we do, and we want to make it more convenient? How much more convenient do you want to make it?” he said. “Do we want to go to their house? Take the polling booth with us?”

“This is a hard-fought privilege,” he added. “This is something people die for. You want to make it convenient? The guy who died to give you that right, it was not convenient. Why would we make it any easier? I want ‘em to fight for it. I want ‘em to know what it’s like. I want them to go down there, and have to walk across town to go over and vote,” he said.

We might want to make voting easier because we are America. For the record: Politifact ruled that Bennett's statement that Africans have to "walk two and three hundred miles" to vote is a pants on fire lie. Bennett vows to ad more voting sites if there are long lines during the 2014 election. I'm not counting on it.

Turkey in Florida Budget

Gov. Rick Scott vetoed money for legal aid and autism. Scott had no problem signing off on a $5 million rowing regetta for Sarasota County. It is no coincidence that Sen. Mike Bennett backed the rowing center. Is Scott going to try to convince voter that rowing is a job creator.

Scott billed himself as anti-rail. J.D. Alexander wanted the Sunrail project approved to create a rail line to his family-owned warehouses. Scott granted Alexander his wish. Bennett wanted a rowing regetta and Scott delivered. Remember Scott running as someone who would stand up to special interests?

I will be shocked if Scott doesn't sign-off on Alexander's pet project Polytechnic. Nothing screams fiscal conservatism like creating an independent school that no wants.

The Great Sports Swindle Redux

It is rare when I actually agree with Florida Sen. Mike Bennett. This may be the only time ever. Bennett and Florida House Rep. Frank Artiles are attempting to get professional sports stadiums that have received state tax revenue to return money. The reason is to sports facilities were suppose to be used for the homeless, on nights when there wasn't an event.


These organizations have failed to follow the law for over 20 years," said Artiles, in a statement. "This is simply the State of Florida holding them accountable."


Sunlife Stadium (home of the Miami Dolphins) has received $37 million. American Airlines Arena (home of the Miami Heat) has received $27.5 million. Both venues are citing as violating the law. I am positive that the Tampa Bay Lightning and Tampa Bay Buccaneers have not used their facilities to house the homeless.

The law is stupid for countless reasons. I have written repeatedly on this blog on the needs of the homeless. That said, why did lawmakers believe that using private businesses to house the homeless would be a good idea. These venues are built for sports and concerts. Furthermore, it was stupid to believe tax incentives would convince sports teams to house the homeless. These teams would just take the money and ignore the law. Which is exactly what they did.

I have written repeatedly on economic studies that find that sports venues have either zero or negative economic impact to their communities. Corporate welfare to sports teams are just a drain on tax revenue. The state legislator could have built several homeless shelters with the money they gave to pro teams.

Clinton Goes After Scott on Voting Rights

Former President Bill Clinton goes after Gov. Rick Scott for signing the highly restrictive voting bill. Clinton's remarks came during a speech to young progressive activists.


"There has never been in my lifetime, since we got rid of the poll tax and all the Jim Crow burdens of voting, the determined effort to limit the franchise that we see today," Clinton added.

Clinton mentioned Gov. Rick Scott's move in March to overturn past state precedent - including under former GOP governors - that allows convicted felons to vote once they've finished probation periods.

"Why should we disenfranchise people forever once they've paid their price?" Clinton said. "Because most of them in Florida were African Americans and Hispanics who tended to vote for Democrats. That's why."


There absolutely is a racial element in how Florida Republicans deal with felons. Scott and Attorney General Pam Bondi rejected Cassandra Jenkins' nomination to the parole commission. Scott and Bondi recited concerns about "safety" that projected prepared talking points. Jenkins had already served on the commission. Neither Scott or Bondi cited one instance where public safety was jeopardized because of Jenkins. It is also worth noting that Jenkins was the only black member of the commission and didn't get reappointed.

State Sen. Mike Bennett said voting should be as tough as it is in Africa. It is impossible to read Bennett's bizarre rant and not think of racism.

Actually, if the voter is handicapped we do want to go to their house to help provide transportation, so they can vote. Bennett would have a disabled person crawl to a voting precinct.

If you never read stories about Africans walking two or three hundreds miles to vote then don't worry. Neither has Bennett. Politifact rated Bennett's bullshit claim a pants on fire lie. Bennett's nonsense is better suited for the white supremist web site Stormfront.org than for an elected official.

Why Mike Bennett Won't Run For Congress

Florida Sen. Mike Bennett is racist and in the pocket of developers. Bennett fits in perfectly in the legislative backwoods known as the Florida legislature. Bennett will never go on to the next level. That is why I laughed when Bennett said he felt a "fire in the belly" to run against Congresswoman Kathy Castor.

Bennett is a C list politician. Castor is a rising star being groomed a leadership role by Nancy Pelosi. Castor's district is one of the safest Democratic districts in the country. Castor's district is bound to look less gerrymandered after redistricting. Castor is still going to keep a solid amount of Democratic voters.

Bennett said that he has "heartburn over constant fundraising, travel and the other demands of running for federal office." Really? Judging by how good Bennett was at shaking down developers for campaign contributions... please.

Bennett has raised $1,318,749 from his campaigns for the Florida House and Senate. Lawyers& lobbyists and real estate are the top two industries that have contributed to his campaigns. Bennett isn't running because he has a problem raising cash. In fact: raising money is the only thing Bennett is competent at. Bennett is afraid of getting his ass kicked by Castor.

Mike Bennett: Friend of Developers

Florida Sen. Mike Bennett has been trying to kill growth management for years. The reason is Bennett runs the PAC Citizens For Housing & Urban Growth. The Florida House and Senate approved HB 7207. Bennett gave his spin on the bill.


“The local governments have been screaming and hollering to ‘give us back control of our communities.’ How could Tallahassee possibly know what is good for downtown Bradenton?” Bennett said.


That's funny. When Bennett was pushing SB 360 last year local governments complained that the change in growth management rules from state to local would increase costs for local government. Judge Charles Francis agreed when he found SB 360 unconstitutional.


The decision by Tallahassee Circuit Judge Charles Francis says the law is an "unfunded mandate" that would force cities and counties to spend at least $3.7 million to rewrite their land-use plans.

"The court finds this amount is not 'fiscally insignificant,' " Francis wrote in his ruling, noting that 264 communities would have to pay at least $15,000 to change their plans.


From a policy standpoint, HB 7207 would create a bureaucratic nightmare. Imagine counties arguing over roads, retention ponds and development taxes with no guiding state policy. Bennett and other Republicans want to get rid of state government oversigth because they believe development lobbyists can buy commissioners and city council members off with campaign contributions. It certainly proved true with Bennett. Developers donate huge into local elections. The late developer Ralph Hughes bought Sen. Jim Norman's wife a house.

Bennett's spin is that we need to get rid of growth management rules to spur more home building to create jobs. This makes no sense when Florida leads to nation with 441,461 unsold foreclosed homes. Who does Bennett expect to buy houses in Florida. Why we are at it, we can ask Bennett and his Republican colleagues why are the "rocket docket" foreclosure courts they created are so ripe with banks using fraudulent documents to illegally remove homeowners from their houses. Bennett's brilliant plan is to build homes that no one wants to buy. Remove owners from those homes. Banks then can't sell those homes. Repeat cycle.

Racist of the Day: Mike Bennett

The Florida legislature is attempted to make the most voting restrictive laws in the country. The legislation cuts down early voting by a week, women who remarried will have to cast a provisional ballot which are usually thrown out. College student that change addresses will also be forced to cast a provisional ballot. Grassroot organizations that register voters face the potential of fines. Sen. Mike Bennett argues in favor the likely illegal voting legislation. Bennett's argument is racist and downright bizarre.

Politifact ruled Bennett's statement about Africans walking "two or three hundred miles" a pants on fire lie. Bennett's comment says more about his misinformed view on Africans than about voting.

I wonder if Bennett would require Republicans to walk to polling precincts. More likely Bennett wants to enact Jim Crow-style voting laws to make voting tougher for blacks that vote Democratic. And this is Bennett's sales pitch for this horrible legislation.

How Anti-Choicers Are Anti-Life

Fetal impairment


It refers to the existence of life-threatening or serious anatomical signs that will lead to either an impaired quality of life or at worst, lethal anatomical malformation which renders the fetus unable to survive outside a pregnant woman's body.


Don't think for a second Republicans in the Florida legislature are pro-life. Republicans in the Senate Banking and Insurance committee endangered the lives of women.


Committee members shot down an amendment filed by Sen. Eleanor Sobel, D-Hollywood, that tried to expand exemptions in the bill from cases when rape or incest is involved to cases where "fetal impairment" could occur.

Republicans on the committee said the term could justify an abortion in almost any case. Opponents said it needs to be there to protect the mother in other instances, but the term should not wear a concrete label because it deals with issues that are very personal.

"That is a condition that needs to be addressed with those physicians and the patient," said Suzie Prabhakaran, an OB/GYN and medical director at Planned Parenthood in Sarasota. "It's kind of a case that you know it when you see it."

The bill passed the committee, 6-4, with Sen. Mike Bennett, R-Bradenton, joining Democrats in opposition. It has one more committee stop before reaching the full Senate floor for a vote.


Good for Sobel for attempting to add the amendment and Bennett (to my surprise) voting with Democrats. The short version is Republicans do not support publicly-funded insurance for abortions, even if the woman's life is in danger. Sen. Gwen Margolis summed up the vote.


"I can barely talk about it," said Sen. Gwen Margolis, D-Miami, visibly upset. "It's incredible to talk about. It's incredible that a bunch of guys are telling us what's right in our lives."

Florida Senate's Anti-Immigration Nonsense

The Florida Senate is holding a dog and pony show of a hearing on immigration. The purpose of the hearing is to stir up the conservative base. Don't expect any actual solutions to be implemented in legislation. Miami Herald reporter Mary Ellen Klas tweets on Sen. John Thrasher's reaction to hearing an inconvenient truth.


Sen. Thrasher acks: How do we stop illegals entering the workforce? Answer from FIU prof Ediberto Roman: hold employers accountable.


Go after the business community is the last thing Thrasher and other Republicans want to do. It is very simple. Cut off the employment and illegal immigration will go down. Illegal immigration has already gone down because of how bad the economy is in the United States.

It is no secret that Plant City, Florida is staunchly Republican and is home for many illegal immigrants. The Florida Republican establishment does not want INS agents arrested illegal immigrant in Plant City. It is bad politics and would destroy the strawberry farming business.

Klas has a another quote from FIU prof Ediberto Roman.


FIU prof Ediberto Roman: "We can put all the fences we want but...if the business sector is creating that demand they're going to get here."


I don't see where we could build a fence. Is there a stampede of illegal immigrant from Alabama that I don't know about? I certainly don't expect Mexicans to swim from Mexico to Florida.

Nothing will come from this hearing.

Update: Klas has filed her article. An interesting finding is that illegal immigration is down 25 percent in Florida. I guarantee that dramatic increase is because the Florida economy tanked.

The Senate hearings an immigration gave the Senate few (if any) options. Republicans are now trying to slow walk this back.


``There probably will not be an Arizona-immigration style bill that passes the Florida Senate,'' said Sen. Mike Bennett, a Bradenton Republican.

Bennett said he's deeply concerned with the part of the bill that's most identified with Arizona's law: The requirement that local police officers with ``reasonable suspicion'' attempt to determine a person's immigration status during a routine traffic stop or arrest.


Scott hasn't committed to Rep. William Snyder's bill. Scott has mostly avoided talking about illegal immigration after he won the Republican primary. This is a lot of political posturing. If the Florida legislature passes a bill local police officers won't have enough officers and resources to enforce it. Law enforcement will mostly ignore the bill and focus and violent crimes and thefts in the districts. It is not like Scott and the Florida legislature are going to give money to hire new law enforcement officers. There are tax cuts to be passed and a 3.5 billion deficit to deal with.

Florida Goes Arizona on Immigration

Florida Sen. Mike Bennett's illegal immigration bill will have people that can be put in jail for not carry proper identification. Essentially, you will have to prove you have a legal right to be here. Regardless of whether you are a U.S. citizen or have a visa.


(b) A person who is arrested shall have his or her 50 immigration status determined before the person is released.
(c) The immigration status of the person stopped, detained, or arrested shall be verified with the Federal Government pursuant to 8 U.S.C. s. 1373(c).



(13) A person who willfully fails to complete or carry an alien registration document required under subsection (10) 148 commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. However any fine imposed 150 under this subsection may not exceed $100. A person who violates this subsection may be sentenced for up to 20 days in jail. A person who violates this subsection a second or subsequent time 153 may be sentenced to up to 30 days in jail.

(14) This section shall be implemented in a manner consistent with federal laws regulating immigration, protecting civil rights of all persons, and respecting the privileges and immunities of United States citizens.


The bill says race can not be considered. How then will a law enforcement officer know who is an illegal immigrant. Bennent inserted the language merely to get around accusations of profiling. This bill will absolutely lead to profiling. I guarantee we won't see a sudden increase in arrests of Canadian and European tourists.

SB 360 Declared Unconstitutional

Florida State Sen. Mike Bennett was the sponsor of SB 360. The bill repealed the Growth Management Act of 1985. Bennett and Ron Reagan runs the the PAC Citizens For Housing & Urban Growth. The PAC receives contributions from construction and developers. The PAC uses the money to donate to Republican candidates.

Bennett got bad news: Tallahassee Circuit Judge Charles Francis overturned SB 360 unconstitutional. SB 360 allowed developers to be exempt from building or paying for construction of new roads. As policy, it is assinine for groth management and transportation. The taxpayer would be left paying for new roads.

The bill also revises requirements for adoption of impact fees." That translates into developers are off-the-hook from paying local governments. SB 360 is a horrible piece of legislation. Judge Francis did the right thing by declaring it unconstitutional.

Florida Hometown Democracy News

Florida Hometown Democracy has placed Amendment 4 on the Florida ballot. The amendment summary is below.


Establishes that before a local government may adopt a new comprehensive land use plan, or amend a comprehensive land use plan, the proposed plan or amendment shall be subject to vote of the electors of the local government by referendum, following preparation by the local planning agency, consideration by the governing body and notice. Provides definitions.


Voters will have a say by vote on how local governments decide land use issues. Developers have successfully use their lobbying power to influence local elected officials to ignore environmental and smart-growth management.

Florida Hometown Democracy has hired Mitch Kates to be the campaign manager. FHD needs 60 percent of the voters to approve Amendment 4 to place it on the state constitution. Kates has represented progressive candidates and helped Kevin Beckner get elected to the Hillsborough County Commission.

FHD has also hired Wayne Garcia new communications director. That translates into Garcia will be communicated with traditional media and bloggers to help raise awareness on FHD. Garcia has also worked as a campaign consultant. Garcia has been all over the place politically. I am rather surprised he is working with FHD.

The horrible SB 360 is a prime example of how developers can write legislation and get politicians to support a bill that is against the interest of the people. SB 360 getting the Growth Management Act of 1985. The Republican legislators who cry about big government took power away from local governments to decide land use issues. The state can overrule local government by developing land they deem economoic development projects. SB 360 sponsor Sen. Mike Bennett said more houses needed to be built in Florida to turn the economy around. The problem was Florida was in a crushing mortgage crisis. Houses were not selling. Bennett and other members of the Florida legislature were looking for excuses to repay developers for their campaign contributions. Bennett and Rep. Ron Reagan run the PAC Citizens For Housing & Urban Growth. Construction and home builders have contributed over $33,000 to Bennett's campaigns.

The citizens of Florida need Amendment 4 to pass. The current Republican legislature attempted to approve offshore drilling before the Deep Horizon spill. They cannot be trusted to make sound decisions on growth management and environmental issues. Voters need to support Amendment 4 for the sake of Florida's future.

Mike Bennett Caught Viewing Porn Web Site

Florida Sen. Mike Bennett (R) is dealing with a bit of embarrassment. Bennett was caught visiting a porn web site while on the floor of the Florida Senate. Beenett was not on the web page for long. He provided his explanation to Miami Herald.


"I didn't know it was in there. As soon as I realized what it was, I shut it," Bennett said. "I don't know how many girls there were, what they looked like or what they were wearing. I have no idea what the picture looked like because when I saw what it was, I closed it. I had (Sen.) Eleanor Sobel behind me on one side and Sen. Frederica Wilson on the other side. On the side of me is (Sen.) Nancy Detert, who has expressed her dislike for me for a long time. And then there's the Democrat, Dan Gelber, who's running for Attorney General. And we were all talking about these issues. Are you out of your mind? There is no way that anybody would knowingly open up something like this in that situation."




Personally, I don't think it is a big deal. It is funny as hell.

Charlie Crist Loves the Growth Monster Part 2

I wrote last December on how Gov. Charlie Crist loves the growth monster and has no interest in seriously reforming Florida's tax system. Crist sign SB 360. The bill is a giveaway to developers and makes growth management harder.

Crist knew the bill was a stinker and held no public signing ceremony. Sponsor Sen. Mike Bennett wrote SB 360 for the purpose of gutting the Growth Management Act of 1985. New houses will be built (in a state with a foreclosure crisis) in any area deemed economic development projects.

Developers are a huge lobbying industry in Florida. County commissions will stumble over each other designating lands fit for "economic development. Nevermind if local communities can handle to increased traffic and water needs. Politicians will leave that for others to worry about as they seek higher office.

Compassionate Conservatism: Making the Unemployed Pay to Be Drug Tested

Draconian potential law of the day: Florida Sen. Mike Bennett has the bizarre idea to randomly drug test people collecting unemployment. SB 2062 will create a "Drug Deterrence Program within the Agency for Workforce Innovation." My question is who is going to pay for the drug testing. Many companies don't drug test because it's expensive. People on probation pay for their drug testing through money they pay to county correctional systems. An estimated 800,000 people are unemployed. The cost of drug testing will be deducted from unemployment checks. Can you feel the compassioniate conservatism?

The bill requred 10 percent of unemployment recipients be drug tested. That translates into 80,000 people. No money will be appropriated for drug rehabilitation to people that fail drug testing. Bennett isn't interested in rehabilitation.

Text of SB 2062.


(a) The Agency for Workforce Innovation shall implement aprogram no later than October 1, 2009, of drug testing, on a random basis:
1. Ten percent of individuals who make a claim for benefits; and
2. Ten percent of individuals who are receiving benefits.
(b) In creating and implementing the program, the agency shall:
1. Develop a procedure for random selection of individuals for testing and shall ensure that the testing occurs on a statewide basis and reasonably correlates to the population distribution in the state;
2. Make a determination of eligibility under s.443.101(1)(d) before an applicant is selected for drug testing;
3. Provide notice of the potential for drug testing to individuals claiming and receiving benefits; and
4. Require an individual to be tested to sign an acknowledgement that he or she has received notice of the agency's drug testing policy and that he or she has a right to refuse to take the drug test;
(5) TESTING; USE OF RESULTS.—
(a) An individual is disqualified from receiving or continuing to receive benefits upon:
1. Refusing to submit to testing under this section; or
2. Upon testing positive for drugs as a result of a test under this section.
(b) If the individual fails the drug test required under this section, the individual is not entitled to unemployment benefits for up to 52 weeks, under rules adopted by the agency, and until he or she has earned income of at least 17 times his or her weekly benefit amount.
(c) The agency shall provide any individual who tests positive with information on drug treatment programs that may be available in the area in which he or she resides; however, the agency or the state is not responsible for providing or paying for drug treatment as part of the testing conducted under this section.


"I guarantee people are supporting their drug habits on your unemployment," Bennett told the Brandon Herald. Any 10 percent of the American population will produce people using drugs. Bennett is testing 80,000 people. No one will be surprised to find drug users. Bennett takes the classic conservative view that poverty and unemployment are character flaws. Bennett views these unemployment recipients as lazy and worthy of punishment. Nevermind that his party's economic ignorance helped create Florida's flawed tax system and a busted real estate market. It never occurred to Bennett that his economics opportunities would be different if he was born a black child in Sudan.


“People are hurting and people are losing their jobs, and in the midst of that situation, this would treat everyone facing a job crisis and seeking unemployment compensation as a potential drug abuser,” said Courtenay Strickland, ACLU director of public policy.


Bennett responds to this sort of criticism that (in his word) he is "picking on the junkies." Bennett's sensitivity is underwhelming.

The Impact Fees Tax Shift

Florida Sen Mike Bennett is sponsoring SB 630. The bill is designed to favor the development industry. Florida is second in the country in foreclosures. It is no coincidence the real estate industry is Bennett's top campaign contributors. New development would drive down the already unstable real estate market and forced the public to pay for new roads and sewage. Infrastructure costs will not go away. The expenses will be shifted away from developers. Welcome to Florida's tax shift game.

The last thing needed is the construction of new homes. A Miami Herald and CBS study found it will take years to sell current empty homes. This study was done before the recession.


CBS and the Miami Herald collaborated to report that at the current sales pace, it would take nearly three years to sell all the condominiums on the market. For single-family houses, it would take almost two years. Meanwhile the U.S. dollar is plummeting to record lows.

The Hillsborough County Commission is using the recession has an excuse to waive impact fees. The county is experiencing a 20-month backlog of homes. Smart Growth activist Mariella Smith wrote, "Incredibly, four of the seven commissioners — Jim Norman, Ken Hagan, Kevin White & Al Higginbotham — see the solution to our housing glut as MORE housing." And many Florida pols would rather have you pay the impact costs than developers.

Let the Voters Decide on Sports Franchise Pork

Finally, a voice of moderation against pork spending for sports franchises. Sen. Mike Bennett (R-Bradenton) deserves kudos for this proposal.


"Every person who thinks their property taxes are high right now should be contacting their legislature and the governor’s office and demanding that we not use their hard-earned money to support a professional sports franchise. If they want to have that taxpayers money, then let the taxpayers vote on it."


Amen. Sports arenas do not put money back into the community.
